A man with a criminal history involving sexual offenses, Kevin Melody, found himself in further legal trouble after failing to adhere to mandatory registration requirements while living rough in Lancashire.

The authorities revealed that Melody, aged 51 and residing on Laithe Street in Burnley, neglected to register with the police every seven days as legally mandated.

This failure to comply with sex offender registration laws was compounded by his absence from scheduled appointments with the probation service and missing two court hearings during a particularly tumultuous period in his life.

The case was heard at Blackburn magistrates court, where Melody pleaded guilty to two counts of breaching the conditions of his sex offender registration.

The court was informed that his non-compliance was not a one-time occurrence but spanned several months, specifically in May, June, and October.

Additionally, Melody failed to attend court on two separate occasions and did not meet with probation officers as required.

These breaches highlighted a pattern of neglect and disregard for the legal obligations imposed upon him.

District Judge Alexandra Preston addressed the court, acknowledging the breaches but also considering Melody’s difficult circumstances.

She noted that the defendant had been experiencing homelessness throughout this period, which she described as a significant factor in his non-compliance.

Recognizing these hardships, Judge Preston decided to suspend the prison sentence of 10 weeks, which would have otherwise been imposed, for a period of 12 months.

Her decision reflected a degree of leniency, taking into account the challenges Melody faced.

Prosecutor Julia Draper explained that Melody’s homelessness was a key reason for his failure to report to police regularly.

Under the law, individuals like Melody are required to report to police every seven days to allow authorities to monitor their whereabouts and ensure public safety.

Draper stated that Melody claimed to have gone to Nelson police station to sign on but found it closed.

He then attempted to report to Burnley police station, but he alleged that he was assaulted and forced into an alley, where he was beaten and told to stay out of Burnley altogether.

In his defense, Janet Sime, representing Melody, acknowledged her client’s struggles with securing stable accommodation.

She admitted that Melody had missed signing on and attending scheduled appointments with the probation service but emphasized that he had recently obtained a new address through a friend.

Sime expressed hope that this new residence would facilitate better compliance in the future, noting that with a fixed address, Melody would only be required to sign on once every 12 months.

The court’s decision reflected a balance between enforcing legal obligations and understanding the personal difficulties faced by Melody.

Nonetheless, the case underscored ongoing concerns about the management and monitoring of convicted sex offenders, especially those experiencing homelessness and instability in Lancashire.
