FERMOY MAN JAILED FOR SEXUAL ASSAULT ON TEEN NEAR CHURCH EVENT
Kamil Szymczak, a 34-year-old man with an address in Fermoy, appeared before Mallow District Court charged with sexually assaulting a 16-year-old girl near Chapel Hill in Fermoy shortly after 1 pm on Monday.The charge was brought under Section 2 of the Criminal Law (Rape Amendment Act), 1990.
The teenage girl cannot be identified for legal reasons.
Detective Garda David Forsythe reported that Szymczak made no response to gardaí when formally charged after his arrest.
Szymczak, who has been living in Ireland for almost a decade, appeared in court wearing dark slacks and a branded black top, and was assisted by a Polish interpreter.
He was detained at Fermoy Garda Station and faced objections to bail from the Gardaí, who requested his remand in custody due to the seriousness of the alleged offense involving a juvenile, the potential sentence, and other legal issues.
Defence solicitor Ciaran O’Keeffe indicated his client wished to apply for bail.
The judge, Alec Gabbett, convicted that the defendant had allegedly gone behind the victim and attempted to forcibly remove her undergarments, emphasizing the severity of the case.
Bail was refused, and Szymczak was remanded to appear again in court via video link on February 15.
He was granted free legal aid, and a court order was made to prevent publication that could identify the juvenile.
