In a significant legal case heard at Belfast Crown Court, a man from north Belfast, Jonathan Evans, was spared immediate imprisonment after admitting to attempting to possess an indecent image of a child.

The incident dates back to July 31, 2016, and the court proceedings took place via videolink from Evans's solicitor’s office.

Judge Donna McColgan QC presided over the case and sentenced Evans to 12 months in prison.

However, she chose to suspend this sentence for a period of two years, meaning Evans will not serve time unless he commits another offence within that timeframe.

Additionally, the judge ordered that Evans be placed on the Sex Offenders Register for the next ten years.

Jonathan Evans, aged 36 and residing on Mill Valley Drive in Belfast, pleaded guilty to a single count of attempting to possess an indecent image of a child.

The offence was committed nearly five years prior to the court hearing, and the case was initiated following a conversation between Evans and a man in England.

This man was under police investigation at the time, which prompted further scrutiny.

During the hearing, Judge McColgan described the conversation between Evans and the English man as “extremely disturbing” and “based upon fiction.” She emphasized that the conversation was also “sexually explicit and graphic,” which contributed to the seriousness of the case.

When authorities seized and examined Evans’s computer equipment as part of their investigation, no actual indecent images of children were discovered.

This absence of concrete evidence led to the charge being classified as attempting to possess such images, rather than actual possession.

In her sentencing remarks, Judge McColgan acknowledged the defence’s submissions, including the delay in bringing the case to court, Evans’s clean criminal record, and the genuine remorse he expressed since the incident.

She noted that although the offence met the threshold for immediate custody, she was inclined to suspend the sentence due to these mitigating factors.

Addressing Evans directly, the judge stated, “If you do not offend within the next two years, then that’s the end of that.

If, however, you offend within the next two years, you will serve the 12 months that I’m now suspending for a period of two years.

Do you understand that?” Evans responded affirmatively, saying, “Thank you, Your Honour.” The court’s decision reflects a cautious approach, balancing the seriousness of the offence with Evans’s apparent remorse and the circumstances surrounding the case.
