WARMINSTER DOCTOR JOHN PAYNE ESCAPES JAIL DESPITE CHILD PORNOGRAPHY CHARGES

In November 1996, Dr. John Payne, a general practitioner based in Warminster, Wiltshire, found himself at the center of a serious legal controversy involving allegations of possessing and transmitting indecent images of children. The 48-year-old doctor, who had served the local community for over two decades, faced charges after police raided his home in September following a tip-off. During the search, authorities confiscated several computer files containing explicit images, raising questions about his involvement with illegal material.

Specifically, Dr. Payne admitted to possessing four images of children in indecent poses stored on his personal computer. These images, which depicted minors in compromising and inappropriate positions, were found within his home system, although there was no evidence suggesting he had transmitted these images to others. Additionally, he acknowledged having one image of a homosexual pornographic nature, which, while not illegal in itself, became a criminal matter because he had transmitted or received it via telephone lines, an act that contravenes the law.

At West Wiltshire Magistrates’ Court in Trowbridge, the prosecution, represented by Ms. Warren, clarified that there was no indication Payne had shared the child images through his computer. Instead, she emphasized that he had failed to delete these images from his computer’s memory, which constituted a breach of the law. She also noted that Payne had volunteered to cooperate with police and computer experts to thoroughly examine his system, ensuring no other illegal material was stored there.

During the proceedings, Charles Goodbody, representing Payne, highlighted the defendant’s standing within the community. He described Dr. Payne as a respected figure, not only as a doctor serving a large patient base but also as an active participant in various local activities. Goodbody stressed that Payne had a clean record prior to this incident and was well-regarded by his peers.

The magistrates decided to adjourn the case until December 6, 1996, to receive further reports and released Dr. Payne on unconditional bail. On that date, he was sentenced to perform 120 hours of community service. Goodbody explained that Payne’s interest in computers and the internet was longstanding, and he had subscribed to chat lines where data could be downloaded without necessarily viewing it directly. He insisted that Payne had no interest in children and was surprised to find these images on his system, asserting that he was an innocent witness to material he should not have encountered.

Goodbody further explained that Payne used the internet as a form of escapism, finding solace in online discussions with people thousands of miles away. He emphasized that Payne was not the creator or distributor of the illegal images but had merely come across them inadvertently. The defense argued that Payne’s actions did not involve inciting or producing the material, and he was not involved in any criminal activity beyond possessing the images unintentionally stored on his computer system.
