JAMAICAN MAN JERMAINE SCOTT SENTENCED FOR HIV TRANSMISSION IN CHESHIRE
In a significant case originating from Cheshire, a man named Jermaine Scott has been sentenced to serve three years in prison after being found guilty of recklessly transmitting HIV to a woman.The prosecution revealed that Scott, a 39-year-old originally from Jamaica, appeared before Chester Crown Court on Tuesday, April 4, where the court handed down the sentence following his guilty plea to a charge of grievous bodily harm under section 20.
The legal proceedings uncovered that Scott had been diagnosed with HIV in 2005.
Despite having access to prescribed medication that, if taken consistently, would have eliminated the risk of transmitting the virus to others, Scott failed to adhere to his treatment regimen.
This neglect significantly increased the danger posed to his sexual partners.
The incident was further compounded by the fact that Scott did not inform his partner—who was also his former girlfriend—of his positive HIV status.
Their relationship had previously ended but was rekindled in the summer of 2009.
When their relationship resumed, Scott was not regularly taking his medication, which heightened the possibility of transmitting HIV.
Unknown to the woman, Scott intentionally concealed his diagnosis and engaged in unprotected sex with her.
Her suspicions about Scott’s behaviour grew over time, leading her and Scott to visit a sexual health clinic in October 2009.
During this visit, Scott provided a false name and fake medical details to the healthcare workers, complicating efforts to trace his medical history.
Following the clinic visit, the woman tested positive for HIV.
Subsequently, the couple ended their relationship, and Scott left the Cheshire area altogether.
The incident was reported to Cheshire Constabulary in October 2009, prompting an official investigation aimed at locating Scott.
Thanks to a public appeal by law enforcement, Scott was eventually traced and arrested in February 2011.
However, during the arrest, Scott refused to answer questions posed by officers.
Despite the detailed investigation, authorities initially lacked sufficient evidence to formally charge Scott related to the transmission, and the case was temporarily closed.
Disturbingly, it was later discovered that Scott was in the UK illegally, leading to his deportation in November 2011.
Following his deportation, the victim requested the case be reopened.
This led detectives to consult with medical experts, who concluded that it was highly probable the woman had contracted HIV within the three months prior to her diagnosis, during her relationship with Scott.
Genetic analysis further revealed a link between the HIV strain she was diagnosed with and the strain identified in Scott, establishing a strong association between him and her infection.
In 2019, the new medical evidence was handed over to the Crown Prosecution Service (CPS).
They subsequently decided to proceed with the case, and in February 2020, Scott was formally charged with grievous bodily harm.
An extradition warrant was issued to facilitate his return to the UK, and after being located abroad, Scott was brought back in November 2022 to face trial, where the case of his reckless transmission of HIV was thoroughly examined and resulted in his sentencing.
