In August 2017, Jamie Maclennan, a radiographer employed by the NHS from Larbert near Falkirk, was sentenced to prison for sexually assaulting three teenage girls during an 18th birthday celebration held at Macmerry Miners Club in East Lothian.
Maclennan, who also worked as a DJ at the event, was found guilty after a five-day trial at Edinburgh Sheriff Court. The court heard that during the party in April of the previous year, he lured a 15-year-old girl into an isolated toilet cubicle with the apparent intent to rape her, forcing his hands down her underwear and attempting to force her head towards his genitals.
He claimed that the girl had initiated flirtation by dancing provocatively while he played records and that they engaged in flirtatious banter, suggesting she had come on to him. Despite his claims, the jury found him guilty of the offences.
A second victim, aged 17, was assaulted when Maclennan forcibly grabbed her arms and compelled himself upon her, kissing her repeatedly and placing her hand inside his trousers to touch his genitals. The third victim, also 17, was slapped after she asked him to play her favorite song.
Maclennan denied the allegations but was convicted on two counts unanimously and on a third by majority. Following his arrest at the Western General Hospital in Edinburgh the week after the incidents, he broke down multiple times in court while maintaining his innocence.
Sheriff Thomas Welsh QC sentenced Maclennan to 27 months in prison and ordered him onto the sex offenders register for ten years. The sheriff described the offences as serious, noting the abuse of power involved: "I have listened very carefully to what has been said and I have listened very carefully to all the evidence given by the teenagers in this case. These are serious offences and are characterised by an abuse of power on your part. In my view, you forced yourself on to the victims in this case and I am satisfied custody is inevitable."
The victims' testimonies were heard in a closed court, and their complaints led to Maclennan’s arrest. Maclennan’s behavior during the trial was emotional; he repeatedly pleaded innocence and broke down several times, but ultimately was found guilty on all counts related to the sexual assaults.
