Fife Man Guilty of Assault Has Tag Removed to Attend Church

FIFE MAN GUILTY OF ASSAULT HAS TAG REMOVED TO ATTEND CHURCH

A man from Fife, James Smith, who is 32 years old and residing on Campbell Street in Dunfermline, has been involved in a violent assault against a female neighbour in Burntisland, occurring on April 14 and 15.

A jury found him guilty after a trial.

Smith previously committed the assault by placing the woman in a headlock and grabbing her breast, actions reportedly motivated by his bad mood and exacerbated by health issues.

During police interviews, Smith claimed he suffers from multiple sclerosis and described his state as a 'day of rage' caused by personal and familial problems, which led to the altercation.

The victim reported that Smith threatened torape her during the incident.

In June, Smith was sentenced by Sheriff MacNair to a community payback order with two years of supervision and a restriction of liberty order for 12 months.

Nevertheless, Sheriff Alastair Brown subsequently ended the tagging requirement, citing Smith's request for more time to attend church meetings and enjoy leisure activities such as swimming and going to the gym.

The court acknowledged the incident as extremely frightening for the victim, highlighting the severity of the assault.

Smith's case involves serious violence, and his monitoring tag has been removed to allow him access to religious and leisure activities, despite the prior assault and guilty verdict.
