DRUNK PASSED OUT IN TAKEAWAY THEN PRETENDED TO PERFORM SEX ACT IN FRONT OF CHILDREN
An alcoholic was found “passed out” in a Chinese takeaway before he mimicked a sex act over his trousers in front of children.Everington was charged with theft from a shop and being drunk and disorderly in a public place.
He pleaded guilty to both offences.
The court heard how he had been found by police officers in a Chinese takeaway, Derbyshire Live reports.
He was ordered to stay inside his home from 7pm – 7am every night for four weeks.
For being drunk and disorderly, Everington was given a conditional discharge for 12 months.
While on bail, Everington visited Tesco Extra in Ilkeston with another man around 8pm on January 13, where he stole over £50 worth of meat.
His last theft was eight years ago.
The court prosecutor described his behaviour as “being aggressive in a Chinese takeaway” at about 5.30pm on December 30.
He was found by police passed out on the floor and later lying on the pavement, pretending to masturbate over his trousers.
The incident involved members of the public, including children.
He was arrested.
He was fined court costs of £85 and a victim surcharge of £90, bringing his total pay to £175, and received a four-week community order with a curfew.
