    IAIN MUNRO FROM BALMEDIE LOSES APPEAL AFTER CHILD ABUSE CONVICTION IN EDINBURGH

    In a case that has stirred significant concern within the Aberdeenshire community, Iain Munro, a 21-year-old resident of Balmedie, has had his appeal rejected following his conviction for child abuse. The incident in question involved the indecent assault of a four-year-old boy while Munro was acting as a babysitter at a residence in Aberdeenshire in May 2006.

    Munro maintained his innocence throughout the trial, but the jury at the High Court in Edinburgh found him guilty by a majority verdict in March 2009. The court sentenced him to a term of 30 months in prison for his actions. Having served half of his sentence, Munro was released from Craiginches Prison on July 16 and has since returned to his home in Balmedie.

    Despite his release, the repercussions of his conviction continue to resonate deeply with the victim’s family. The mother of the young boy, who has chosen to remain anonymous for legal reasons, expressed her distress and concern over the potential risks her son faces. She stated, “We have been told by the court officials that he has served his sentence and there is nothing anyone can do to stop him coming home.”

    She further explained her fears, saying, “My son is still struggling to come to terms with what happened, and his counsellors say that coming into contact with Munro could have a devastating effect on him – I’m just not prepared to take the risk.” The mother also revealed that her son is due to return to school next month, which raises difficult questions about how to ensure his safety and emotional well-being.

    At the time of the offence, Munro was employed as a nursery care assistant. His address was listed as 6 Eigie Avenue, Balmedie. During the trial, Munro’s legal representative, David Moggach, argued for leniency, citing Munro’s health condition. Munro suffers from cystic fibrosis, a serious genetic disorder that requires constant medical attention. He takes up to 50 tablets daily and needs ongoing care. A specialist doctor’s report warned that Munro’s life expectancy could be reduced by several years due to his condition.

    Despite these considerations, Lord Kinclaven at the High Court in Edinburgh emphasized that Munro’s health issues did not warrant a departure from a custodial sentence. He stated, “Despite everything said on your behalf, there is no alternative to a custodial sentence,” reaffirming the court’s decision and dismissing Munro’s appeal against his conviction.
