A sex offender who indecently assaulted a woman while she was asleep has been ordered to complete 240 hours of unpaid work.
Iain Charlton, 36, of Tripwell, Brough, Whalsay, was sentenced at Lerwick Sheriff Court yesterday to a community payback order with an 18-month supervision requirement.
He will also remain on the sex offenders register for the duration of the order.
Charlton previously admitted to rubbing his hands up the woman’s back and unhooking her bra while she was asleep at an address on St Magnus Street in the town.
He had been attending a party and was interested in the woman, though she did not share his feelings.
Once she became aware of his presence in the room, she felt unable to speak and rolled out of bed, landing on the floor before fleeing the scene to seek help.
Defence solicitor Tommy Allan stated that Charlton has struggled with the incident but accepted responsibility for his actions.
He noted that the incident was not prolonged and that Charlton left the scene once it was clear the woman did not consent to his advances.
Sheriff Marion MacDonald cautioned Charlton, saying, 'This must have been a very upsetting incident for the woman in this case.'
