Man is placed on Sex Offenders’ Register after groping schoolgirls
A Paisley pervert who groped schoolgirls as they sat on his living room couch was slammed by a sheriff yesterday for continuing to protest his innocence.
Ewan Toghill, 39, abused a 14-year-old and a 15-year-old on separate nights at his home, trying to make one of the attacks look like he touched the girl while reaching for a TV remote control.
He was convicted of assaulting the teens, who
can’t be named for legal reasons, following a trial at Paisley Sheriff Court last year.
Toghill was placed on the Sex Offenders’ Register, and a Community Payback Order, and returned to the dock yesterday for a review of his progress on the order.
Sheriff Colin Pettigrew said: “I regret to see you don’t accept any responsibility and continue to deflect blame on to the victims, but that is where we are.”
And, after hearing that Toghill has since left Paisley and is now living in Ayrshire, Sheriff Pettigrew transferred the case to North Ayrshire Council social workers to administer, adding: “They have been dealing with you anyway, but it makes it easier for
them, given where you now stay.”
He also heard Toghill had completed 148 of the 300 hours’ unpaid work as part of his sentence, and added: “You have made a good fist of the number of hours. I’ve no reason to believe you won’t complete the work.”
Prosecutor Frank Clarke had previously told how Toghill touched the older girl then claimed he was reaching for the telly remote.
He said: “She described how she and a friend were on the same settee.
“She described how her friend had been sleeping for around 20 minutes.
“She described how he placed his hand and fingers on her inner thigh.
“She didn’t know what was going on.
“She looked at him and asked ‘What are you doing?’.
“He replied: ‘Sorry pal, I was just trying to get the remote’.”
Toghill assaulted the 15-year-old, after she had been drinking, at his home in Paisley’s Fereneze Drive between December 1, 2015, and January 31, 2016.
The creep pawed at the younger teen while she was also sitting on a sofa, placing his hand on her leg and rubbing her thigh at a flat he lived at in the town’s Brown Street between December 1, 2014, and New Year’s Eve.
Mr Clarke added: “The victims were visitors to his home.
“The incidents occurred when they were distracted watching television.
“They are said to have occurred on a brown corner settee.”
Sheriff Pettigrew placed Toghhill on a Community Payback Order, telling him to carry out 300 hours’ unpaid work.
He was also placed on the Sex Offenders’ Register and fined a total of £500 for breaking bail conditions and failing to sign the Sex Offenders’ Register within the required time.

A pervert groped two schoolgirls as they sat on his living room couch.
Ewan Toghill, 38, mauled the 14 and 15-year-old on separate nights at his home.
A third claim he pawed at a woman’s private parts as she slept was found not proven.
The creep has been placed on the Sex Offenders Register after he was found guilty of assaulting the teens following a trial at Paisley Sheriff Court .
Prosecutor Frank Clarke told how he touched the older girl then claimed he was reaching for the telly remote.
He said: “She described how she and a friend were on the same settee.
“It was in the early hours of the morning.
“She described how her friend had been sleeping for around 20 minutes.
“This is when the incident occurred. She described how he placed his hand and fingers on her inner thigh.
“It was very close to her private area. She didn’t know what was going on.
“She looked at him and asked, ‘what are you doing?’.
“He replied: ‘Sorry pal, I was just trying to get the remote.’”
Neither of the girls can be named for legal reasons.
Toghill assaulted the 15-year-old after she had been drinking.
He pounced at his home in Paisley’s Fereneze Drive between December 1 2015 and January 31 the following year.

He placed his hand on her leg and rubbed her thigh at a flat he moved to in the town’s brown street between December 1 2014 and Hogmany the next year.
Mr Clarke argued the cases should be tried together and demonstrated a clear pattern of offending.
He added: “The victims were visitors to his home.
“The incidents occurred when they were distracted watching television.
“They are said to have occurred on a brown corner settee.”
The woman claimed she was touched while she slept at another of Toghill’s addresses in Dalry, Ayrshire, in 2014.
Mr Clark insisted her recollection of the night was hazy, but she remembered waking up while being fondled.
He added: “Like many things in life, when something of great importance happens, that remains in the memory.
“She referred to the incident as sexually inappropriate.”
Toghill could be seen visibly shaking when the two guilty verdicts were returned.
Toghill could be banned from working with children after being found guilty of assault.
The court ruled there was a significant sexual element to his offending.
Sheriff Colin Pettigrew called for background reports and ordered Toghill to meet with social workers.
He said: “I have taken a considerable amount of time to reflect on this case.
“I am satisfied a reasonable person would consider your behaviour sexual.
“These young girls were children.
“You are subject to notification of the sex offenders legislation.”
Toghill, of now Glencairn Road, has been ordered to return for sentencing on July 24.
