ERIC SMITH AND SHOCKING NIGHTTIME INTRUSION AT YORK HOME
In a disturbing incident that has left the local community of York shaken, Eric Smith, a 37-year-old man from Outgang Lane Caravan Site in east York, was sentenced to prison for a night-time invasion of a woman's residence that resulted in multiple sexual assaults.The court heard that Smith unlawfully entered the woman's home during the early hours, exploiting an unlocked door, which allowed him to gain access without any apparent forced entry.
The victim, whose identity has been protected for privacy, was awakened to find Smith standing beside her bed.
Prosecutor Tony Dunne described the scene, stating, "She woke up to find Eric Bristow Smith standing by her bed.
He quickly put a hand over her mouth and said, 'You want raping, you whore.'" It was alleged that Smith appeared to be under the influence of alcohol or drugs at the time, which may have contributed to his erratic and aggressive behavior.
According to the court proceedings, Smith carried out two sexual assaults during this terrifying episode and attempted to expose the woman’s legs, though she resisted his advances and managed to escape from her home.
The woman reported to police that she was struggling to breathe and was in a state of panic throughout the ordeal, which lasted approximately ten minutes.
In a personal statement shared with the court, the victim disclosed the profound impact the incident has had on her life.
She stated that she had been forced to move to a new address and is now undergoing medication for depression.
Her words reflected her confusion and distress, as she expressed, "I cannot understand why he did it to me or why it happened." Following his arrest on the same day, Smith admitted to being inside the woman’s property but denied sexually assaulting her, claiming that his intoxicated state caused him to have no memory of the events.
Detective reports confirmed that Smith had access to the victim’s home through the unlocked door, which facilitated his intrusion.
During sentencing at York Crown Court, Judge Andrew Napier sentenced Smith to a prison term of 27 months.
He was also ordered to register as a sex offender for a decade.
The court was informed that Smith's behavior prior to this incident appeared to be non-violent, and his defense lawyer, Caroline Abraham, attested that he had maintained a clean record since the offenses.
She highlighted the complex personal circumstances faced by Smith, mentioning his significant family responsibilities, including caring for his ailing mother.

Abraham also provided context on Smith’s recent history, revealing that his father-in-law had succumbed to COVID-19, and another close family member was battling the illness during the period leading up to the incident.
This series of tragedies, combined with his struggles with alcohol, reportedly led Smith to seek solace in drinking.
Since the incident, with the support of his family, Smith has reportedly ceased alcohol misuse.
The court was also informed that there had been a considerable delay before Smith faced prosecution, a factor often considered in legal proceedings.
