EMANUEL DINIZ SENTENCED IN CARDIFF FOR CHILD RAPE VIDEO SHARED VIA HEOL TIRBACH CHAT GROUP
In November 2016, Emanuel Diniz, a 32-year-old resident of Heol Tirbach, was formally sentenced at Cardiff Crown Court after admitting to the distribution of a highly disturbing and illegal video depicting a child being raped.The court proceedings revealed the disturbing details of how Diniz’s actions came to light and the subsequent legal consequences he faced.
Authorities from North Wales initiated an investigation into a man’s mobile phone, during which they discovered the Kik messenger application, a platform known for file sharing capabilities.
As part of their inquiry, police uncovered a chat group discussion that involved serious allegations of child sexual abuse, with members sharing explicit images and videos.
Among these was a 44-second video clip, classified as Category A—the most severe classification—showing a young girl being subjected to sexual assault.
This video was posted by a user operating under the pseudonym 'Diamond Sally.' Further investigation traced this username back to Emanuel Diniz, linking him directly to the heinous content.
During the court hearing, it was revealed that Diniz had used a false identity, adopting a woman’s persona, to gain access to a private adult pornography chat group intended for gay women.
This deception was part of his attempt to conceal his involvement and access restricted content.
On August 5 of the same year, Gwent Police executed a search warrant at Diniz’s residence in Heol Tirbach.
However, he was not present at the time.
Later, Diniz voluntarily attended Ystrad Mynach Police Station, where he informed officers that his mobile phone had been destroyed near Taunton in Somerset.
Prosecutor Gareth Jones stated that the police believed Diniz’s actions were deliberate and that he was fully aware of the nature of the material he had shared, dismissing any claims of inadvertence.
Defense lawyer Marian Lewis emphasized Diniz’s personal circumstances, noting that he is married and has been in a committed relationship for 13 years.
She described him as a hardworking and conscientious husband and father, expressing that the offense was a shock to his family and that he fully recognizes the gravity of his actions.
The court was also informed that Diniz had no prior criminal record.
Judge Michael Fitton QC sentenced Diniz to 16 months in prison.
Additionally, he imposed a sexual harm prevention order that will last for ten years, restricting Diniz’s access to certain online platforms and activities.
The judge criticized Diniz for not being truthful during his interview with the probation service, stating that his claims of ignorance about the content he shared were dishonest and that his guilty plea should not be diminished by his later statements.
Furthermore, Diniz was ordered to register as a sex offender for ten years, reflecting the seriousness of his offense and the impact on public safety.
