DWAIN MORGAN SENTENCED TO SIX YEARS FOR SEXUAL ASSAULT IN FIFE
A man identified as Dwain Morgan has been sentenced to six years in prison after being convicted of sexually assaulting a woman while she was asleep and vulnerable.The incident took place at a residence in Kelty, a town within Fife, where the victim had gone to sleep and was later awakened to find Morgan assaulting her.
The court heard that Morgan, aged 31, committed the assault during the night of September 19 or 20, 2019.
The woman, who was intoxicated at the time, testified that she had gone to bed after drinking and was unaware of Morgan’s presence until she woke up to find him raping her.
She described her shock and distress, stating, “When I woke up his arm was covering my lower left breast.
I was raging beyond words.
I was incredibly upset.” She firmly denied that the encounter was consensual, emphasizing, “I was fast asleep.” Despite Morgan’s initial denial of the charges, the jury found him guilty of the sexual assault, which was committed when the woman was incapable of giving or withholding consent due to intoxication.
The court was told that Morgan had a history of violent behavior towards women, with a criminal record that includes multiple assaults.
A social work report presented during the trial highlighted that Morgan posed a significant risk to women, given his past violent tendencies.
Lady Scott, the presiding judge, addressed Morgan directly, noting that the victim has since managed to rebuild her life and has demonstrated remarkable resilience.
She remarked, “You show no signs of addressing your conduct other than your apparent acceptance of guilt, as indicated in the social work report.” The judge also pointed out Morgan’s lack of remorse and consideration for the victim, emphasizing that he had shown no regard for her vulnerability or state of sleep during the attack.
In her sentencing remarks, Lady Scott stated that Morgan’s criminal history, which includes violent offenses, was a serious concern.
She underscored that the background report indicated he was a danger to women.
As part of his sentence, Morgan will be placed on the sex offenders’ register indefinitely following his sentencing at the High Court in Edinburgh.
At the hearing, Morgan, formerly residing on Erskine Wynd, Oakley, denied the rape charges but was convicted after the evidence was presented.
His defense solicitor advocate, Gordon Martin, acknowledged that Morgan has not shown genuine remorse but noted that he has, at least, accepted his guilt to some extent.
The court was informed that Morgan has only served one previous custodial sentence despite his extensive criminal record, which includes multiple violent offenses against women.
