KNIGHTSWOOD DAD-OF-TWO JAILED FOR THREATENING A SECOND PARTNER
A KNIGHTSWOOD dad has been jailed for threatening a second partner.David Smith, 27, pleaded guilty to shouting, swearing and uttering threats and abusive remarks at a woman in Dumbarton, and to spitting on her head.
But Dumbarton Sheriff Court also heard how it was not the first time he treated a woman in such a way.
Depute fiscal Scott Simpson told the court the relationship had been going for about a year before ending and the former partner was with a friend in Riverside Lane, Dumbarton, on August 24 this year.
He said: “The two of them were sitting on a wall by the bus stop.
At about 2.15pm, the witnesses became aware of a person in a van.
The accused in the van began shouting from the van, a tirade of abuse towards the complainer.
“She got up to remonstrate with the accused and informed him he was creating an unnecessary scene.
“He continued shouting and swearing.
It appears he had information contained in his phone to suggest the complainer had been with another male.
He put that proposition to the complainer and approached her and spat on her face.” As dad-of-two Smith, of Keal Avenue, returned to his vehicle, he shouted: “I’m getting someone to take your face off.” His ex made her way into the High Street where he again shouted at her and threatened her dad, who was not even with her at the time.
Police spoke to Smith later that evening.
His defence solicitor said this was the “death throws” of the relationship and that he was called by the complainer and went to meet her.
“Clearly, it does not excuse his actions that day,” said the lawyer.
“He accepts they were horrible.
“He had a custodial sentence in the past and one analogous matter.” The previous offence was with a different partner, he added.
The court was told Smith’s family made £7,000 available, equivalent to a “level five” compensation order as an alternative to jail.
But Sheriff Simon Pender said: “This was horrendous behaviour and the incident in charge two was gruesome.” Smith was jailed for a total of seven months, backdated to August 25, and a non-harassment order imposed for two years to prevent him contacting his ex.
