A man from Middlewich, Cheshire, who was previously convicted of sexually assaulting a disabled woman aboard a train, has been brought back to court following a failure to comply with the legal requirements of the sex offenders register.

David Kemp, aged 60 and residing at Manor Fields, appeared before Crewe Magistrates Court on Tuesday, June 7, to face sentencing related to this breach.

The earlier crime took place on June 12, 2015, when Kemp sexually assaulted a vulnerable woman aboard a train near Sandbach.

He had a prior conviction for this act, having been sentenced to six months in prison on September 7, 2016, for that offence.

During that incident, Kemp and the victim happened to board the same train at Sandbach Station.

Kemp then approached her in an empty carriage, asking her to shift seats so he could sit beside her.

When she declined, he attempted to engage her in conversation, which she also refused.

Undeterred, Kemp dropped to his knees in front of her and began to run his hand up her leg, a clear act of sexual assault.

The victim responded immediately by reporting the assault to the train guard, leading to Kemp’s arrest by British Transport Police at the next station.

Following his arrest, he was sentenced to six months in prison and was placed on the sex offenders register for six years, with his registration period concluding in September 2022.

Despite this, Kemp recently breached the legal requirement to keep his details updated on the registry.

The current court hearing addressed his failure to sign the register as mandated.

As a consequence, he was fined £120 for neglecting this obligation.

Additionally, he was ordered to pay £85 in court costs and a £34 victim surcharge.

The court also took into account his earlier guilty plea related to the sexual assault when determining the penalty.

This series of events highlights ongoing concerns regarding compliance with sex offender registration laws, especially in cases involving repeat offenders and vulnerable victims.
