In May 2022, a disturbing incident occurred on the East Coast Main Line involving a pensioner from Sunderland, David Gilbert, who narrowly avoided imprisonment after committing an indecent act aboard a train traveling between Newcastle and Edinburgh.

According to court reports, Gilbert, aged 76, was observed engaging in inappropriate behavior while seated on the train.

Witnesses saw his hand moving beneath a newspaper on his lap as he fixated on a sleeping female passenger seated nearby.

The incident was brought to the attention of train staff and fellow travelers when Gilbert’s actions became apparent.

The train, operated by LNER, was approaching Newcastle Central Station when Gilbert was detained by police officers.

It was noted that his jeans were undone, and he was exposed, which led to his arrest.

Gilbert, who resides on Westheath Avenue in Sunderland, was taken into custody after the train arrived at the station.

The authorities found him with his trousers unfastened and his genitals exposed, confirming the nature of his misconduct.

Earlier this month, Gilbert appeared before Newcastle Magistrates’ Court to face charges of outraging public decency.

He pleaded guilty to the offense, and the case was adjourned to allow for the preparation of a pre-sentence report.

It was revealed that Gilbert has a history of similar offenses, with convictions dating back to 2014, 2015, and 2016, all involving inappropriate conduct with newspapers on trains.

During the sentencing hearing, Deputy District Judge Andrew Teate acknowledged Gilbert’s admission of deriving a “thrill” from performing sex acts in public.

The judge noted that these urges appeared to impair his rational judgment.

While recognizing that Gilbert has previously been given community disposals that seemed to have some effect, the judge stated that the severity of the current offense warranted a more substantial response.

Ultimately, Gilbert was sentenced to a three-year community order.

Deputy Judge Teate explained that this decision was made to give Gilbert the opportunity to participate in a sex offenders’ treatment program, which could aid in managing his urges.

The judge emphasized that a custodial sentence was considered but deemed unnecessary, as a short-term jail term would likely have little positive impact.

The incident took place around 9 pm on December 4 of the previous year.

A fellow passenger, Stephen Davies, acting as a witness, recounted that he saw Gilbert staring at a sleeping 20-year-old student.

Davies described how he observed Gilbert’s reflection in the train window, noting that Gilbert was leaning towards the aisle with a newspaper on his lap.

Although the witness could not see Gilbert’s genitals directly, he observed that Gilbert’s trousers were open and that he appeared to be masturbating beneath the newspaper.

The female passenger, who was the target of Gilbert’s gaze, awoke during the incident and saw Gilbert cease his actions when she confronted him.

After the woman fell back asleep, Gilbert continued his inappropriate behavior until he was challenged by her partner, who instructed him to “put everything away” and removed the newspaper.

The couple then contacted a friend sitting in another carriage, who was an off-duty police officer, and they alerted train staff to the situation.

Police officers were waiting at Newcastle Central Station when the train arrived, and Gilbert was promptly arrested.

At the time of his arrest, he was still with his trousers open and his genitals exposed.

The victim, the young woman, later expressed her concerns about her safety and her cautious approach to travel following the incident.

She remarked that she had initially believed Gilbert to be a benign, elderly man reading a newspaper, which made his actions all the more shocking.

She also expressed gratitude toward the members of the public who intervened to stop him.

In addition to the community order, Gilbert was subjected to a Sexual Harm Prevention Order for ten years.

This order prohibits him from sitting directly opposite, beside, or diagonally across from any lone female on public transport.

It also bans him from having any bags or items on his lap while traveling.

Furthermore, Gilbert was ordered to pay £100 in compensation, along with £85 in court costs and a £95 victim surcharge, as part of his sentence.
