BABYSITTER DAVID FLEMMING FROM WARRINGTON JAILED FOR SEX WITH 14-YEAR-OLD GIRL
In July 2008, David Flemming, a 19-year-old babysitter from Warrington, was sentenced to prison after engaging in consensual but illegal sexual activity with a 14-year-old girl.Flemming, who had no fixed address, pleaded guilty to having sexual intercourse with the minor while caring for her during her aunt’s absence in Warrington town centre.
Prosecutor David Jones explained to the court, “She (the girl) was staying with her aunt.
The aunt saw Flemming in the street around 11pm and mentioned she wanted to go out to town, with Flemming agreeing to look after her.” According to Mr.
Jones, after the aunt left the house around midnight, the girl and Flemming ordered pizza, and then the girl went to bed.
Flemming followed her upstairs and repeatedly asked for sex, eventually touching her.
The court was told that the girl initially refused but later agreed to have unprotected sex with Flemming.
When questioned after the incident, Flemming claimed, “She came on to me.
She had been trying to sleep with me for ages,” and stated he was unaware she was under 16.
However, Judge Elgan Edwards dismissed these claims.
Fleming’s actions were discovered when the girl’s aunt returned at 3am to find Flemming and her niece in bed, both clothed.
He admitted to having sex with the girl on no more than two occasions.
Fleming’s solicitor, Andrew Downie, described his client as “very immature for his age” with a troubled background.
He added, “He is on a (prison) wing with older, more serious sexual offenders, and his time in custody has been extremely difficult for him.” Ultimately, Judge Edwards sentenced Flemming to one year in prison, commenting, “You have an unimpressive record.
The girl in question was only 14.
Girls should be protected.
I’m afraid it’s got to be custody but I keep it very much below the guidelines.” Flemming had a history of 11 previous convictions covering 27 offences, mostly related to dishonesty.
Upon release, he will be barred from working with children unless informed otherwise and has been required to sign the sex offenders register.
