A man named David Findlay has been sentenced to prison for serious sexual and abusive conduct, following his conviction under the recently enacted Domestic Abuse (Scotland) Act 2018.

The incident took place in Edinburgh, where Findlay, aged 32, engaged in a series of abusive behaviors that caused significant physical and psychological harm to his former partner.

His actions did not stop there; he was also found guilty of abusing another woman, instilling terror through threats and physical assaults.

Findlay’s case is notable as he was among the first individuals to be convicted under the new legislation, which came into force in April 2019.

The Act broadens the legal definition of domestic abuse to include a pattern of harmful behavior that can be physical, verbal, psychological, sexual, or financial.

This legislation aims to better recognize the complex and often hidden nature of domestic abuse, especially when it involves repeated conduct over time.

During the trial at the High Court in Edinburgh, the jury heard detailed accounts of how Findlay’s abusive behavior escalated.

The abuse reportedly began with insults and intimidation tactics, gradually progressing to physical violence.

One of the victims recounted that her ordeal started shortly after she met Findlay through a dating application.

Both women described being subjected to strangulation by the accused, highlighting the severity of the violence inflicted upon them.

On October 21, Findlay was sentenced to five years in prison.

Additionally, he received a three-year extended sentence, which will require close supervision upon his release.

His name has been permanently added to the Sex Offenders Register, and he is subject to a 15-year Non-Harassment Order that covers both victims, restricting any contact or communication with them.

Commenting on the case, Fraser Gibson, Scotland’s Procurator Fiscal for High Court Sexual Offences, expressed his support for the victims and the effectiveness of the new legislation.

He praised their courage in coming forward and emphasized that the Domestic Abuse (Scotland) Act 2018 provides prosecutors with a powerful tool to seek justice.

Gibson explained that the Act recognizes a course of abusive behavior that can include serious sexual offenses, and that when there is sufficient evidence of repeated conduct linked to a pattern of abuse, it can be prosecuted as a comprehensive case.

Gibson reaffirmed the commitment of the Crown Office and Procurator Fiscal Service (COPFS) to vigorously pursue justice for victims of sexual and domestic abuse.

He assured the public that every available legal measure, including the provisions of the Domestic Abuse (Scotland) Act 2018, would be utilized to hold offenders accountable.

This case serves as a reminder that abuse, often hidden behind closed doors, can take many forms, and the legal system is increasingly equipped to address and penalize such conduct, providing hope and confidence to victims across Scotland.
