EDINBURGH MAN DAVID BURNS SENTENCED FOR SEXUAL OFFENSES INVOLVING 13-YEAR-OLD GIRL
In a case that has shocked the community of Edinburgh, David Burns, aged 21, was sentenced to three years in prison after being found guilty of engaging in unlawful sexual activity with a 13-year-old girl.The incident took place in April 2008 at a flat located in Westburn Grove, a residential area within Edinburgh.
According to court proceedings, Burns initially invited the young girl to accompany him to his flat.
Once there, he removed his trousers and asked her to engage in sexual activity.
Although he was originally charged with the more serious offence of rape, Burns ultimately pleaded guilty to a reduced charge of having unlawful sexual intercourse with a minor.
The High Court in Edinburgh heard that Burns told the girl not to tell anyone about what had happened and warned her not to become pregnant.
Despite these warnings, the girl later returned home intoxicated and visibly distressed.
She confided in her mother, expressing fears that she might be pregnant due to her recent sexual encounter.
Concerned, her mother took her to a medical professional to confirm whether she was expecting.
It was during this process that the mother learned about Burns and the nature of her daughter’s distress.
The advocate depute, John Scullion, explained that the girl’s mother later confronted Burns at his residence, questioning him about the incident.
Initially, Burns denied having any sexual contact with the girl.
However, he eventually admitted to having sexual intercourse with her, which led to the police being contacted by her mother out of concern for the girl’s safety and the fact that Burns was a 20-year-old man involved with a minor.
Prosecutor Mr.
Scullion noted that Burns had previously lived at the same flat with a girlfriend and that he met the girl while she was walking in the street.
He explained that Burns had gone to the flat to check his mail and had asked the girl to accompany him there.
During sentencing, Lord Kinclaven acknowledged the severity of the offence.
While he initially considered a four-year sentence, he took into account Burns’s guilty plea and the circumstances of the case.
The judge emphasized the importance of deterring similar conduct and highlighted that Burns was aware of the girl’s underage status at the time of the offence.
As part of his sentence, Burns was placed on the sex offenders’ register.
Lord Kinclaven also ordered that his name be referred to Scottish Ministers for inclusion on a list of individuals deemed unsuitable to work with children.
Additionally, Burns will remain under supervision for an extra year to monitor his conduct and ensure public safety.
