In December 2018, a disturbing case emerged involving a young man from Cheltenham who was caught in possession of and distributing highly disturbing images of child abuse.

Danrick Magno, a 19-year-old student residing on Whaddon Avenue in Oakley, found himself at the center of a serious criminal investigation that revealed the extent of his involvement in the circulation of vile and illegal material.

Magno was charged with multiple offenses, including three counts of making indecent photographs of children and four counts of distribution.

The case was heard at Gloucester Crown Court, where Judge Ian Lawrie QC presided over the proceedings.

The court was informed that police, acting on a search warrant executed on March 29, uncovered a horrifying collection of images stored on Magno’s laptop and mobile phone.

Among these were 206 images classified as Category A, representing the most severe form of child abuse material.

Prosecutor James Haskell detailed the police operation, explaining that investigators had become aware of Magno’s online activities through email addresses and Twitter accounts linked to him.

These accounts were being used to both store and share illicit images.

Initially, Magno denied any knowledge of the images when questioned by authorities.

However, during a subsequent interview, he admitted to his involvement, providing a stark acknowledgment of his actions.

Further examination of his electronic devices revealed a disturbing collection: 206 Category A images, 111 Category B images, and 80 Category C images.

The prosecutor emphasized the severity of the content, stating, “It was beyond mere perverse imagery.” The court heard that Magno was actively engaged in online communication with others about the distribution of these images, particularly via Twitter.

Evidence suggested that he was motivated, at least in part, by financial gain, as he exchanged messages asking about the availability of children from China or Japan and offering images for trade.

Some of the images depicted boys as young as three years old, highlighting the heinous nature of the material involved.

Magno maintained to police that he had no sexual interest in children.

However, by the time he met with a probation officer for a pre-sentence report, his stance had shifted, indicating a possible acknowledgment of his culpability.

The court was also informed that Magno’s electronic devices were to be destroyed, a decision ordered by the judge.

While it was noted that Magno had no previous convictions, the judge expressed grave concern over the nature of his crimes.

“This goes beyond mere perverse imagery,” Judge Lawrie stated.

“Some victims are as young as three.

The critical issue here is the distribution.

Watching images at night is one thing, but sharing them with others is another matter entirely.” Representing Magno, solicitor Mark Linehan acknowledged the seriousness of the case but argued that the number of images involved was relatively low for this type of offense.

He emphasized that Magno’s actions were driven by sexual gratification rather than financial motives, despite the evidence suggesting otherwise.

The defense also highlighted that Magno had shown remorse and had entered an early guilty plea, which warranted a reduction in his sentence.

In light of these factors, the judge initially considered a starting point of three years’ imprisonment but ultimately decided to suspend the sentence.

Magno was sentenced to 20 months in jail, suspended for two years, and was ordered to participate in a sex offenders treatment program.

The judge remarked, “If anyone needs to sit in a room and talk about his issues, it is him,” underscoring the importance of rehabilitation.

Addressing Magno directly, the judge expressed deep concern about his lack of understanding of the harm caused by his actions.

“There is a dark corner of your soul,” he said.

“You are helping to perpetuate misery for these young victims, who are emotionally and psychologically tortured by your actions.

Your viewing and distribution of this material show a disturbing lack of humanity.” The court also ordered Magno to register as a sex offender and to be subject to a sexual harm prevention order for seven years.

The judge concluded with a stark warning about the dangerous nature of such offenses, emphasizing the need for ongoing monitoring and intervention to prevent further harm.
