In January 2013, a disturbing case emerged involving Daniel Stenhouse, an 18-year-old resident of Cardross, who was convicted of heinous crimes committed during a house party in Dunbartonshire. The incident, which took place in July 2012, involved the sexual assault of a 15-year-old girl while she was asleep, an act that has left a lasting scar on the victim's life.
According to court proceedings, Stenhouse forcibly engaged in sexual activity with the young girl without her consent. The victim, who was intoxicated and asleep at the time, awoke to find Stenhouse on top of her. Despite her efforts to push him away, he overpowered her, pinned her to the floor, and committed the assault. The attack was witnessed by friends present at the gathering, and a photo later surfaced online showing a semi-nude girl with a man identified as Gavin Docherty, another individual involved in the case, giving a thumbs-up. Docherty, also 18, was found guilty of pulling down the girl’s underwear and slapping her bottom, actions that contributed to the overall assault.
Further details revealed that after the assault, Stenhouse poured urine over the girl, leaving her drenched and humiliated. The prosecutor, Advocate depute Paul Kearney, emphasized the profound impact this traumatic event had on the victim’s life, highlighting the severity of the offences committed.
At the High Court in Glasgow, Lord Pentland delivered the sentence, condemning Stenhouse for his actions. He stated, “You were convicted of raping a 15-year-old girl when she was asleep and intoxicated and incapable of giving consent. You had no respect for the complainer and made a conscious decision to take advantage of her for your own sexual gratification.” The judge sentenced Stenhouse to six years in detention, reflecting the gravity of his crimes.
Gavin Docherty received a different punishment; he was sentenced to 250 hours of unpaid work and ordered to pay his victim £1000 in compensation. Lord Pentland also addressed Docherty directly, saying, “You showed no respect whatsoever for this young woman and treated her in a degrading way. You should be thoroughly ashamed of yourself.”
Both men, who are first-time offenders, were placed on the sex offenders’ register, marking the serious consequences of their actions. The case has shocked the community of Cardross and Dunbartonshire, highlighting the importance of justice for victims of sexual violence and the ongoing need for vigilance and support for those affected by such heinous acts.
