CHELTENHAM MAN CODY NICHOLAS TARGETS 13-YEAR-OLD GIRL ON FACEBOOK
In December 2013, a disturbing case emerged involving a young girl from Cheltenham who was subjected to inappropriate online advances by a man she had met at a Halloween party.The incident came to light when the girl, only 13 years old at the time, was approached through social media by Cody Nicholas, a 22-year-old resident of Moors Avenue, Hester’s Way.
According to court proceedings at Gloucester Crown Court, the girl had initially met Nicholas at a friend's Halloween gathering the previous year.
The very next day, Nicholas initiated contact with her via Facebook, beginning a series of messages that would reveal his predatory intentions.
The court heard that Nicholas started engaging her in sexually explicit conversations, describing his desire to 'talk dirty' and asking her to perform sexual acts.
The young girl, described as 'charmingly naive' by the court, did not fully understand the implications of Nicholas’s messages.
She was confused by his suggestive language and sought clarification from others, indicating her innocence and lack of experience in such matters.
Despite her innocence, Nicholas persisted in his attempts to manipulate her, asking her to perform acts on herself, which she did not comprehend at the time.
It was only after her mother became aware of the unusual contact—through a friend who informed her—that she took action.
The mother reviewed her daughter’s Facebook account and discovered the messages.
The girl later confided in her mother, expressing embarrassment and difficulty in explaining what Nicholas had asked her to do.
When police arrested Cody Nicholas, he claimed to have experienced blackouts and stated he could not remember the details of his interactions with the girl.
The court also learned that Nicholas had a prior conviction for sexual assault in 2005, adding a troubling context to his recent behavior.
During the court hearing, Judge Jamie Tabor QC condemned Nicholas’s actions, emphasizing the predatory nature of his conduct.
The judge stated, “You engaged in sexualized conversation with a girl who really was still just a little girl.
Such behaviour is predatory and reflects very badly on you.” Judge Tabor sentenced Nicholas to a two-year community order, which includes 60 days of attending a sex offender programme.
Additionally, he was placed on the sex offender register for seven years, marking him as a significant risk to the community.
The judge also praised the girl for her moral strength in resisting Nicholas’s advances and expressed concern over the rapid loss of her innocence caused by his actions.
In conclusion, the court highlighted the importance of protecting vulnerable minors from predatory individuals like Cody Nicholas, whose actions have serious legal and social consequences.
