During the sentencing, Judge Moss expressed his views on the case, stating, “I accept there was no coercion or threat. I also saw the girl giving evidence by video, and in my chambers, and it occurred to me that she was particularly naive.”
The judge further revealed that during medical examinations, doctors discovered evidence of far more serious abuse inflicted upon the girl, which Hart was not charged with. This revelation added a layer of gravity to the case and highlighted the severity of the misconduct.
The court heard that Hart was approached by the girl’s mother, who asked him to take her daughter to school. The relationship of trust between the adult and the child was severely breached, especially considering Hart’s mid-30s age and the girl’s innocence.
Hart was sentenced to 12 months for two counts of indecent assault, six months for attempting to induce the girl to touch his genitals, and an additional 18 months for more serious assault. All sentences are to run concurrently, meaning Hart will serve a maximum of 18 months in prison. It is expected that he will be released after serving nine months of his sentence, given the concurrent nature of the penalties.
