CHARLIE ELPHICKE AND SHOCKING SEXUAL ASSAULT CASE IN KENT

Disgraced former Conservative Member of Parliament Charlie Elphicke is currently facing new legal proceedings in connection with his failure to settle prosecution-related costs following his conviction for sexual assault.

Elphicke, who previously represented Dover in Kent, has come under renewed scrutiny as he grapples with financial obligations stemming from his criminal case.

Elphicke, aged 50, was convicted after a week-long trial during which evidence was presented against him, leading to his sentencing in September 2020.

He was found guilty of three counts of sexual assault involving two women and was subsequently sentenced to a term of two years in prison.

Following his conviction, he served approximately half of his sentence and was released from incarceration in September 2020.

However, he is now embroiled in further legal complications at Uxbridge Magistrates Court, which convened on a recent Friday to address the issue of his alleged failure to pay a £35,000 fine.

The fine was imposed as part of his sentence on September 15, 2020, with the order requiring Elphicke to pay the amount within one year.

This cost was intended to cover the expenses of prosecuting the case and was meant to be paid directly by him rather than burdening the public purse, as stipulated by the sentencing judge, Mrs Justice Whipple.

During the hearing, she emphasized that Elphicke had significant equity in his family home, which was then on the market for sale, as a means to satisfy the debt.

Representing Elphicke, barrister Ian Winter QC, explained to the court that his client was grappling with substantial debt.

He also disclosed that Elphicke’s estranged wife, Natalie Elphicke — who is now serving as the Member of Parliament for Dover — had loaned him a sum of £100,000 to cover legal expenses.

The Court and Tribunals Service (HMCTS) is actively pursuing enforcement of the fine through its powers, which can include issuing a summons to Elphicke to explain why the payment remains outstanding or to determine when he plans to settle the debt.

Failure or refusal to pay the fine could lead to the initiation of a criminal charge.

According to court officials, Elphicke is expected to attend the upcoming hearing on Friday.

If he fails to do so, authorities may issue a warrant for his arrest to ensure his appearance before the court.

The legal troubles for Elphicke extend beyond the financial realm.

In March, he challenged his custodial sentence in the Court of Appeal, arguing that the duration was excessive and should have been suspended.

His appeal was denied, reinforcing the original two-year sentence.

The judge who sentenced him during the trial did not shy away from characterizing him as a sexual predator who exploited his public status as a guise for his misconduct.

The judge described Elphicke's actions as deceitful and highlighted the troubling nature of the allegations.

During the trial, jurors learned of disturbing details, including an incident where Elphicke inquired about bondage and sexual activity with one of his victims, subsequently kissing her and groping her breast.

Court proceedings also revealed that he chased the woman around his home while chanting, “I’m a naughty Tory,” inappropriately maintaining a provocative and offensive attitude.

In the aftermath of the case, disciplinary actions were taken within Parliament.

The Commons Standards Committee determined that five Conservative MPs, including Elphicke's wife Natalie, had breached the House of Commons' code of conduct.

They were found to have made an egregious attempt to influence the legal process, resulting in the suspension of Natalie Elphicke, Sir Roger Gale, and Theresa Villiers for one day.

Additional MPs, Bob Stewart and Adam Holloway, also participated in writing letters to senior judiciary officials, raising concerns over a lesser judge’s consideration of character references submitted for Elphicke.

Charlie Elphicke’s political career included a stint as a Government whip during David Cameron’s administration in 2015.

However, following allegations of sexual assault, he was suspended from the Conservative Party in 2017.

Despite this, he had his party whip reinstated a year later amid a crucial confidence vote in Prime Minister Theresa May, a decision that sparked controversy.

The whip was eventually withdrawn once again after the Crown Prosecution Service announced the charges against him, marking a stark fall from political prominence.

Elphicke's legal and financial struggles highlight the ongoing fallout from his criminal conduct and the broader scrutiny of misconduct within political circles in Kent.

His case continues to unfold as he faces legal obligations and potential criminal consequences due to his refusal or inability to settle the imposed costs.
