BRYAN HUSSEY'S HORRIFIC SEXUAL ASSAULT IN KIDDERMINSTER: TOP JUDGES REJECT APPEAL
In a case that has shocked the community of Kidderminster, Bryan Alwyn Hussey, a 68-year-old pensioner, was convicted of a disturbing sexual assault involving an 11-year-old girl.The incident occurred on a Halloween night several years ago, leaving a lasting impact on the young victim and prompting a stern response from the judicial system.
Hussey, residing on Franchise Street in Kidderminster, was sentenced to six years in prison at Worcester Crown Court last November after being found guilty of sexually assaulting the young girl.
The court heard that Hussey had put his hands beneath the girl’s clothing and touched her inappropriately during the night.
Additionally, he attempted to kiss her, actions that led to charges of sexual assault.
The victim, who was only 11 at the time, was deeply affected by the assault but did not disclose what had happened until she received sex education lessons at school, which helped her understand the nature of Hussey’s misconduct.
The judge described the attack as “grotesque” and emphasized the trauma inflicted upon the young girl.
At the time of the incident, Hussey was reported to have recently separated from his wife.
Despite denying the allegations, a pre-sentence report characterized him as “manipulative and predatory,” noting that he minimized the severity of his actions.
His legal team argued that the trial judge should have given greater consideration to Hussey’s personal circumstances and his otherwise clean criminal record when determining his sentence.
Hussey’s appeal to the Court of Appeal was heard by three senior judges, including Mrs Justice Dobbs, Lord Justice Pitchford, and Mr Justice Walker, at the London court.
Hussey contended that his six-year sentence was insufficient and that the judge had not adequately weighed his personal situation.
However, the judges dismissed his appeal, with Mrs Justice Dobbs stating that Hussey was fortunate to receive only six years given the gravity of his crimes.
She pointed out that Hussey had not admitted guilt, which could have resulted in a sentence of up to eight years.
The court also highlighted that the mitigating factors presented in Hussey’s case were properly considered but ultimately outweighed by the aggravating factor of the victim’s young age.
In conclusion, the court reaffirmed the original sentence, underscoring the seriousness of Hussey’s actions and the need for justice for the young girl affected by his predatory behavior.
