MAN CONVICTED OF HISTORIC RAPE OF FIVE-YEAR-OLD GIRL IN FIFE
A man has been convicted of the historic rape of a five-year-old girl in Fife.Brian Walker, aged 36, was found guilty of assaulting the child, who cannot be named for legal reasons, at an address in Kirkcaldy on September 16, 2006.
Walker, from Bo’Ness, West Lothian, maintained his innocence and wept in court as the verdict was delivered.
The jury took only moments to convict Walker on the charge of raping the young girl, who did not disclose her ordeal until December 2020.
Following the conviction, the judge, Lady Haldane, explained the legal process, noting that since Walker had no prior prison sentences, a background report would be needed before sentencing.
Walker protested his innocence during this hearing, stating, "I didn’t do it.
I didn’t do it." The court proceeded to remand him into custody, with sentencing scheduled for August 20, 2025.
His defence advocate, Michael Anderson KC, requested bail, but it was denied.
Lady Haldane said, “The nature of the conviction means a custodial sentence is inevitable.
In these circumstances, bail is revoked.” UPDATE 20/08/2025 Walker was jailed for six years The trial judge, Lady Haldane, said at a sentencing hearing at the court: “You have been convicted of the rape of (the victim) in September 2006 when you were aged 17 and she was only five.” She said: “Self evidently such an experience at such a young age is likely to have long lasting effects.” Lady Haldane said that a victim impact statement made it clear that was the case for the victim of his offending.
The judge said that Walker continued to maintain his stance of denial over the offence as was his right.
She said a background report prepared on him noted his own unsettled and traumatic childhood and that he had suffered abuse.
Lady Haldane said that Walker committed an offence that resulted in “significant harm” and added that given the nature of the crime there was no alternative to a significant prison sentence.
She told Walker that he would be placed on the sex offenders’ register indefinitely.
