An unsettling case involving Bogdan Raczynski, a man from Edinburgh, has brought to light a serious assault that occurred last year in the city’s well-known and busy district.

The incident, which took place in Raczynski's flat, has led to significant legal repercussions, including his placement on the sex offenders register.

The crime unfolded during a night when Raczynski, 53 years old, took advantage of a sleeping friend who had come to his residence after attending a church service earlier that day.

The victim, who maintained a close friendship with Raczynski for approximately 15 years, had visited his home accompanied by a friend on the evening of March 29 last year.

They first engaged in social activities that involved eating and consuming alcohol, including whisky and vodka, in Raczynski’s flat located within a well-known part of Edinburgh that the court described as “frightening.” According to court reports, the women arrived around 5:30 pm after attending a religious service.

Following the social gathering, which extended over several hours, the women missed their last bus and agreed with Raczynski to stay overnight.

The complainant slept on the living room sofa while her friend used the spare bedroom.

The atmosphere was casual and convivial until the early morning hours.

The court heard that between approximately 3 am and 4 am, the victim awoke to the disturbing sight of Raczynski standing over her.

In a shocking breach of trust, he allegedly grabbed her leg and attempted to remove her leggings.

A physical struggle ensued as Raczynski managed to pull down not only her leggings but also her underwear before she told him to stop.

The woman, in her distress, then lost consciousness.

When she awakened the next morning, she and her friend swiftly left the flat and did not delay in confiding in a trusted friend about the assault.

Motivated by her account, the woman contacted the police to report the incident.

Raczynski, in court, entered a guilty plea to an amended charge of sexual assault, specifically acknowledging that he had repeatedly attempted to remove her lower clothing and struggled with her at his home on that night.

During the sentencing hearing at Edinburgh Sheriff Court on a Thursday, Raczynski’s defense lawyer, Peter Winning, emphasized that his client “accepted culpability” for his actions and that he had ceased his advances once the woman explicitly told him to stop.

Winning also described Raczynski as someone with a “good work history” who leads a “relatively quiet life,” suggesting that his client’s background and earlier conduct should be considered.

Sheriff Kenneth Campbell KC addressed the court, remarking, “When this matter was called before me previously, I heard a full account of the circumstances.

The conduct on this occasion was completely unacceptable.

This must have been a very troubling, upsetting, and frightening experience for the woman concerned.” The sheriff further acknowledged that Raczynski had stopped his inappropriate behavior once the victim expressed her desire for him to desist.

In light of the circumstances, the sheriff decided that custody was not the appropriate penalty in this case.

Instead, Raczynski was sentenced to be placed on the Sex Offenders Register and to be under the supervision of the local social work department for a period of 18 months.

Additionally, he was ordered to perform 225 hours of unpaid community service, a measure aimed at rehabilitation and community contribution.

The case highlights the profound personal impact of the assault on the victim and raises concerns about safety and trust within social and residential environments in Edinburgh.
