BERNARD CALLAGHAN SENTENCED TO 12 YEARS FOR SEXUAL OFFENCES IN EDINBURGH AND FIFE

Bernard Callaghan, a 53-year-old man with connections to Edinburgh and Fife, has been sentenced to a significant prison term after being convicted of multiple sexual offences committed over a span of more than a decade.

The crimes, which involved three different women, took place across the regions of Fife, Edinburgh, and East Lothian, highlighting a disturbing pattern of abuse that persisted from 2007 until 2022.

Callaghan was found guilty at the High Court in Edinburgh on Monday, 4 March, 2024, after a trial that revealed the extent of his misconduct.

The court subsequently scheduled sentencing for Wednesday, 17 April, where a judge imposed a lengthy custodial sentence, reflecting the gravity of his actions and the harm caused to his victims.

Detective Sergeant Craig Donnelly, a representative from Police Scotland’s Public Protection Unit, issued a statement emphasizing the danger posed by Callaghan.

He stated, “Bernard Callaghan is a very dangerous individual who is now being held accountable for his despicable behaviour towards the three victims.

The experiences of these women will undoubtedly leave lasting scars, but I hope that today’s outcome offers them some measure of closure and allows them to begin the process of moving forward with their lives.” Police Scotland reaffirmed its commitment to addressing sexual abuse cases, encouraging victims to come forward regardless of when the abuse occurred.

Detective Sergeant Donnelly added, “We take all reports of sexual abuse extremely seriously and will work tirelessly to investigate and bring perpetrators to justice.

If anyone has experienced this type of crime, they should feel confident to report it to Police Scotland on 101.

There is no time limit for reporting, and victims will be supported throughout the process.” During the sentencing hearing, Lady Poole of the High Court in Edinburgh delivered a stern judgment, imposing an extended sentence of 12 years on Callaghan.

The sentence comprised nine years of imprisonment with an additional three-year extension period.

The court’s decision was based on the conviction of ten charges related to abuse against three women, with the offences spanning over twelve years.

Lady Poole detailed the nature of the crimes, describing how Callaghan’s first victim was involved in a long-term relationship with him, during which he subjected her to physical assaults, injuries, and multiple rapes.

She recounted that when she attempted to leave the relationship, Callaghan stalked her and threatened to kill himself, coercing her into returning to him.

The psychological and physical trauma inflicted on her was profound.

The second victim’s experience was similarly harrowing.

She had a shorter relationship with Callaghan, during which he also raped her.

When she sought to end the relationship, Callaghan’s pattern of harassment persisted, including sending numerous messages and making threats of self-harm if she did not reconcile with him.

The third victim met Callaghan through a dating website.

On their second date, despite her clear refusal, Callaghan raped her.

She described her discomfort and her desire to end contact, but he continued to message her repeatedly until she felt compelled to contact the police.

Lady Poole emphasized that while Callaghan displayed moments of kindness, his conduct was predominantly characterized by manipulative and abusive behaviour.

The court noted the long-term impact on the victims, with some statements indicating enduring psychological consequences.

In her remarks, Lady Poole highlighted that Callaghan lacked insight into his offending and pointed out that his criminal record was relatively short, with only a prior assault conviction from 2005 and subsequent stalking behaviour towards his first victim after their relationship ended.

Notably, he had never been imprisoned before.

The judge considered various risk assessments, including those indicating a high risk of serious harm from interpersonal violence, especially in relation to partner abuse.

She acknowledged the mitigating factors presented on Callaghan’s behalf, such as his difficulties with learning and his employment history, but underscored that society’s intolerance for partner abuse necessitated a firm response.

Concluding her judgment, Lady Poole explained that the cumulative nature of the offences warranted a single, comprehensive sentence.

She stated, “The sentence I impose reflects the seriousness of your crimes and our society’s stance against such behaviour.

Given the pattern of abuse over more than a decade, a lengthy custodial sentence with an extension period is appropriate to protect the public, particularly women who may form relationships with you in the future.” Callaghan’s sentence was backdated to 8 September 2022, the date he was first remanded in custody.

As part of his punishment, he will be placed on the Sex Offenders Register indefinitely.

The court also imposed non-harassment orders and notified the Scottish Ministers regarding his inclusion under the protection of vulnerable groups legislation, ensuring ongoing monitoring and restrictions to prevent further harm.
