SEX PEST CONVICTED FOR ASSAULTING WOMAN AT DUNFERMLINE BAR
A Fife sex pest has been convicted of sexually assaulting a woman during a music event in a Dunfermline bar.In the Monarch on James Street, on April 8 last year, Barry Gibson, 53, grabbed the woman’s bottom and waist and tried to kiss her.
Dunfermline Sheriff Court heard Gibson, of Blair Street in Kelty, had never met the woman before.
Procurator fiscal depute Lauren Pennycook told the court he arrived at the premises intoxicated and rubbed the back of his hand over the woman’s cheek before going to the toilet.
The fiscal depute said: “Around five minutes later the woman has felt someone grabbing her bum from behind.
“She has turned around and seen Mr Gibson standing behind her.
“Mr Gibson then placed his hand onto her waist.
“He has leaned in to say something to her but this was inaudible.” Continued pestering Ms Pennycook continued: “A short while later Mr Gibson has again approached the woman and has tried to kiss her.
“She has turned away while he attempted to do so and asked him to leave her alone.
“Mr Gibson then walked out of sight.
“A short while later Mr Gibson approached the woman again from behind and put his hands around her waist.
“He was asked by a witness to this to leave the woman alone.
“At around 10pm Mr Gibson has approached the woman again and touched her on the waist and then on the bum.
“He has done this while she has been actively moving away from him”.
The woman spoke to a manager, Gibson was moved and police were contacted.
He was traced about seven months later and cautioned and charged.
Gibson appeared in court to plead guilty to sexually assaulting the woman by repeatedly touching her on the body, grabbing her buttocks over her clothing, grabbing her by the waist and pulling her towards him and attempting to kiss her.
Defence lawyer Aime Allan said her client, a first offender, had consumed alcohol that night and had “little to no recollection of events” but accepts the woman must be telling the truth about what happened.
Sheriff Susan Duff adjourned sentencing until March 22 for the production of background reports.
Gibson was placed on the Sex Offenders Register.
