The court heard that Smith had set up a camera in the toilets at Creamfields, a major music festival outside Warrington, where he was working at the time.

Judge Simon Berkson, presiding over the case, refused bail and sentenced Smith to two years in prison, with the sentences of eight and sixteen months to be served consecutively.
