February 2017 Sex offender jailed for raping 12 year old ‘poses high risk to young girls’ An already convicted sex offender who raped a 12-year-old in Ross-shire after being previously banned from going near young girls has been jailed for six years. Alexander Mitchell (23) was on bail accused of having sex with two 13-year-olds when he lured the 12-year-old girl into his bed and raped her. Jailing Mitchell at the High Court in Glasgow judge, Lord Boyd told him: “You asked a 12-year-old girl to climb in your bedroom window and took advantage of her and raped her. “At the time you were on bail for having sex with two 13-year-olds. You have an obvious interest in under age girls.” Lord Boyd said that he would have jailed Mitchell for nine years, but for his guilty plea. He also ordered Mitchell, who is assessed as posing a high risk to young girls, to be monitored in the community for two years after his release from jail. Mitchell was also placed on the sex offenders register. Mitchell of Dornoch in Sutherland made contact with his young victim through social media and then met her and encouraged her to climb into the house in Easter Ross through a window. This was despite the fact he had been granted bail after a sheriff court appearance with a condition that he would not be in the company of girls aged under 16. Police were alerted that a young girl had climbed through a window and when Mitchell answered the door he appeared to be nervous. Advocate depute Ian Wallace said that Mitchell was pale, sweaty and fidgety but insisted that there was no one else in the house. They spotted the girl lying in a bedroom but at the time she said they had just been talking and smoking cigarettes. But in March last year, the girl finally revealed what had happened with Mitchell. She said she had not told the truth about the incident in 2014 “as she was scared of getting into trouble”, the court heard. Mitchell admitted raping the girl when she was 12 in June 2014 at a house near Invergordon. Mitchell, a labourer, has a number of previous convictions for sexual offences. Mitchell showed no emotion as he was led away to begin his sentence. Lord Boyd of Duncansby deferred sentence on Mitchell, described as a prisoner in Inverness, until February for the preparation of a background report. The judge placed Mitchell on the sex offenders register following his guilty plea to rape and remanded him in custody. September 2014 Easter Ross sex offender back in dock for breaching court order AN Easter Ross youth serving 12 months detention for having sex with two underage girls was back in court on Friday. Inverness Sheriff Court heard that Alexander Mitchell (20), currently a prisoner at Polmont, had breached a court order by failing to comply with the requirements of the sex offenders register. Mitchell, formerly of Balintore, was placed on the sex offenders register in May of this year after he admitted having sex with a 14-year-old in Milton and a 15-year-old in Alness. Sheriff David Sutherland heard on Friday that Mitchell breached the order by failing to register his details, including his address, under the Sexual Offenders Act at a police station within three days. Mitchell admitted the breach of bail. Solicitor Aileen Macinnes said Mitchell was sentenced on the sex offences on July 29 and his earliest release date was January 27. Mrs Macinnes said Mitchell left the Inverness court on May 13, after he admitted the offences, and it was his intention to go straight to Perth Road police station in Inverness and register. “Because he was stupid and foolish he got side-tracked and returned to his home in Easter Road and failed to register,” she said. “He failed to carry out the order of the court and has been stupid by his own admission.” Sheriff Sutherland sentenced Mitchell to two months’ detention to run concurrently with his existing sentence. July 2014 Easter Ross youth on Sex Offenders Register for having sex with under-age girls AN Easter Ross youth was sentenced at Inverness Sheriff Court today to 12 months in a young offenders institution for having sex with two underage girls. Alexander Mitchell, who is now 20, was 19 years of age at the time of the offences involving girls aged 14 and 15. His solicitor Aileen Macinnes asked Sheriff David Sutherland to deal with the case by means of a community based sentence rather than custody. But Sheriff Sutherland told Mitchell, formerly of Balintore but whose new address was given in court as Harbour View, Invergordon, they were serious offences. “Young girls ought to be protected. I don’t consider that I can deal with this case other than by a custodial sentence.” Sentence had been deferred for criminal justice social work reports. Mitchell previously admitted having unlawful sex with the 14 year-old at an address in Milton between May 1 and June 1 last year, and the 15 year-old in a lane beside Alness Parish Church on May 4, 2013. Depute fiscal Roderick Urquhart told the court previously the incident involving the 14 year-old followed a gathering of a group of youths who had gone to a house in Milton and played DVDs. About 10pm some of the youngsters moved upstairs to a bedroom and Mitchell went into another bedroom with the 14 year-old, where they had sex on a sofa bed. The following morning depute fiscal Roderick Urquhart Mitchell told the girl’s friend that the 14 year-old was ”not a virgin any more”. The 14 year-old also told her friend in the kitchen she had sex with Mitchell. Friends advised her that Mitchell had a sexually transmitted disease (STD) and told her to get checked out. Eventually social workers and the police were informed. Mr Urquhart said the incident involving the 15-year-old followed a party which had been raided by police because of under-age drinking. Youths left the house and the 15-year-old and Mitchell were with two other youngsters. Mr Urquhart said this girl was six weeks short of her 16th birthday. Mitchell and the girl were seen kissing by their friends who left to go to a bus stop near the church. Mitchell then had sex with the girl before joining the others. At her home the 15-year-old told a girl she had sex with Mitchell. He later denied having sex with both girls when interviewed by police. Ms Macinnes said today that both offences occurred while he was under the influence of alcohol. “There is no suggestion he thought out what he was going to do and he merely acted in a situation due to his consumption of alcohol.” She added that the 20-year-old had no significant record of offending and had “‘showed a degree of immaturity”. Mitchell was also placed on the Sex Offenders Register.
